General Rules and Conditions

The current version dates from November 22, 2022.

At the entrance of the event in question, the most recent version of these terms and conditions will be clearly visible.

Creco, a private company under Belgian law, with registered office at Patersstraat 100, 2300 Turnhout (Belgium) and registered with the Crossroads Bank for Enterprises with company number 0879.287.974 (hereinafter referred to as the “Organiser”) is a company specialized in organizing events .

ARTICLE 1

The general terms and conditions, described below, apply to the event organized by the Organiser, and are supplemented by the internal/organizational measures of the Organizer which can be found at https://www.sunrisefestival.be/houserules. The Visitor guarantees to consult these household measures on a regular basis (every two days) with a view to becoming aware of changes.

The conclusion of an agreement with the Organizer (under which the Visitor is in possession of an admission ticket for the event) entails full knowledge and acceptance thereof.

ARTICLE 2

Each person presenting at the entrance of the event must be in possession of a valid admission ticket or a special authorization issued by the Organiser. An admission ticket is only valid for 1 entry of 1 person and is only valid on the day or days of the event as stated on the admission ticket.

When leaving the event, a new admission ticket is required. Counterfeiting of the admission ticket or any other special access to the site will be prosecuted without exception. If necessary, the Organizer reserves the right to deny visitors access to the event, regardless of a valid admission ticket or special permission issued by the organizer.

Each holder of an admission ticket, or a special permit issued by the Organiser, enters the event site at his own risk and indemnifies the Organizer against any liability, including theft and accidents.

ARTICLE 3

The admission ticket or pass is not exchangeable or refundable by the Organiser.

ARTICLE 4

The admission ticket must be presented when entering the event.

ARTICLE 5

Access to the event is prohibited or denied for people who:
- are clearly under the influence of alcohol, drugs or other stimulants;
- have previously been excluded from events imposed by the Organizer or the administrative or judicial authorities;
- by obvious conduct intending to disturb the public peace or provoke the like by inciting assault, hatred, anger, etc.;
- to resist the control and non-systematic search by the guards and security services of the event;
- refuse to declare objects that are considered dangerous or prohibited by the security services of the event (see article 7);
- act in any way contrary to the provisions of one or more articles of these general terms and conditions.

ARTICLE 6

Any holder of an admission ticket or special admission who wishes to enter the event site must submit to the validation of the ticket or special admission. You may be searched upon entering the event.

Security may ask same-sex ticket holders or special admission holders to voluntarily undergo a superficial inspection of clothing and luggage in order to detect any items that, when brought to the event, could affect the course of the event, the safety of endanger other visitors to the event and disturb public peace. The security guards can request that these objects be relinquished.

ARTICLE 7

Holders of an admission ticket or a special admission presenting themselves at the entrance of the event, as well as persons present at the event, are prohibited from bringing, having brought or possessing the following objects:
- drugs, own drinks or food, bottles, glasses, medicines or stimulants and the like;
- people who need nutrients or medicines for medical reasons (for example diabetes), must be in possession of a medical statement;
- deodorant or perfume in large bottles or sprays (cosmetics in normal shape and size are allowed (max 50 ml));
- vapors, electronic cigarettes and e-liquids that use refillable cartridges;
- any device (umbrella, parasol, tripod for (film) camera, walking stick) that is considered dangerous by the security services for the other event visitors can be refused;
- projectiles or explosives in solid, liquid or gaseous form;
- flammable products or materials, sprays;
- pyrotechnic items such as Bengal fire, etc.;
- any weapon or dangerous, sharp or bruising object that could be used in such a way (sticks, chains, stabbing or stabbing weapons and the like);
- if it can be used as a means of disturbing public peace, endangering the safety of the crowd and/or causing damage to persons and property;
- animals.

ARTICLE 8

At the event it is strictly forbidden for holders of an admission ticket or a special admission to:
- attempting to access inaccessible areas or to be in inaccessible areas of the venue in accordance with the admission ticket or special permission, such as production areas, artist quarters, neutral and VIP areas, press rooms, offices, backstage, etc.;
- climb tents, constructions, fences, fences, light poles, tables, benches or any other infrastructure of the location;
- to block the entrances, exits and evacuation routes and to remain at these locations for longer than is strictly necessary to enter or leave the site;
- disguise or go unrecognized, disturb public peace and endanger the safety of the general public;
- sell or market drinks, food or any other product without the explicit permission of the organiser;
- throwing or shooting an object, liquid or other product in loose or gaseous form;
- smoking in areas where smoking is not allowed;
- urinating in public;
- all vehicles on the site must be provided with a sticker issued by the Organiser.

Violators are responsible for all additional charges.

ARTICLE 9

Texts, symbols, images, gestures and obscene language that incite racism, xenophobia, provocation and discrimination are prohibited.

ARTICLE 10
Visitors must at all times follow the instructions of the Organizer or his appointed or mandated persons on the event site. Failure to comply with this will result in removal from the event site. If necessary, the Organizer can call the police.

The holder of an admission ticket undertakes to comply with the instructions imposed by the Organizer in the context of public peace and safety during the event.

Attendees who are removed from the event for any of the above reasons will be denied entry to the event for the rest of the event, even if they have a new ticket or special access.

In the event that the Organizer denies anyone access to the event site, the former has the right to deny that person their ticket and to deny that person further access to prevent that person from attempting to enter the site. If the Organizer has that person removed from the site, the former is not obliged to refund the admission ticket.

ARTICLE 11

For security reasons, the Organizer reserves the right to:
- interrupt or stop the event;
- temporarily keep the visitors at the location at the end of the event;
- to vacate the location in whole or in part;
- to refuse access to the location, regardless of possession of a valid admission ticket.

The Organizer may be forced to change the program or schedule of the event against its will. In that case, the admission ticket remains valid and cannot be exchanged or refunded.

ARTICLE 12

In order to provide you with the best possible service, it is imperative that we keep and use contact details and other information about you. Of course we also want to respect your privacy. We therefore want to be fully in line with European data protection legislation, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and regarding the free movement of such data (GDPR or AVG).

Everyone who enters the event agrees that he or she may be photographed and filmed and that the images can be recorded and stored. These photos or videos can be used by the Organizer to promote the event. The registration and storage of these images by the police and/or Organizer also takes place with the aim of guaranteeing enforcement and compliance with safety at the event.

The processing of the images aims to prevent crimes and violations of these terms and conditions and to facilitate the detection and punishment of the perpetrators by means of identification.

Photos or videos made by visitors to the site may not be used for commercial or public purposes, unless with written permission from the Organiser.

ARTICLE 13

13.1
Through these terms and conditions, the Organizer informs all visitors that the Organizer collects data to prevent or detect unlawful behavior, to protect or enforce legal rights and for security reasons. This concerns the following personal data: first name, last name, date of birth and country of residence. To the extent permitted by law, the Organizer may also share this personal data (first name, last name, date of birth and country of residence) with government authorities or other competent authorities, in order to protect or enforce its rights or the rights of third parties, or in the detection and prevent fraud or other crimes. These government agencies or competent authorities may advise the Organizer against a cardholder's access. In that case, the Organizer may refuse a ticket holder's access to the event or remove that person from the event. The cardholder is not entitled to compensation.

13.2
In order to process your purchase, the Organizer must share your data with third parties.

13.2.1
The organizer may share your data for the following purposes:
- Check-in procedures and hospitality facilities
- Where permitted by law, cardholders' criminal records may be checked by the government authorities and in case of negative advice from these government authorities, cardholders may be blocked from the event
- Customer service by the event(s) and their ticket providers
- Printing of hard tickets (only if you receive hard tickets)
- Reporting and statistics about visitors to the event(s)
- Security, safety and health measurements
- Ticket and payment processing
- Transactional emails (such as emails to confirm the purchase of your ticket).

13.2.2
The Organizer may share your data with the following parties, to the extent necessary:
- Booking companies
- Cashless payment partner
- Welcoming staff at the check-in points
- Local and federal governments
- Postal companies
- Operational personnel on site
- Payment processing companies
- Printing companies
- Safety and health companies and personnel (such as security or first aid personnel)
- Ticket providers

13.2.3
If you wish to exercise your right to be forgotten, the Organizer must erase all your personal data and can no longer provide you with the services necessary to fulfill your order, nor give you access to the event. In this case, the order will not be refunded.

ARTICLE 14

At the time of purchasing your ticket, it may not yet be known what the exact policy of the (local) government and regulations will be for events in Belgium in the month of June 2023.

In addition, policies and regulations may also change according to the epidemic circumstances of the moment.

The Organizer will inform its visitors in good time when there are important and relevant updates.

If you as a visitor cannot or do not wish to comply with the rules that the Organizer applies or are imposed by the (local) government to allow the event to take place - for example a form of proof of good health (covid-19 negative) - you can this means the refusal of entry to the event without any form of refund.

The visitor accepts the risk that he or so will not be able to visit the event due to travel restrictions imposed by the Belgian government or the government of his or her country of origin. The Organization is then not obliged to provide any form of refund.

If the passage of the event (under normal circumstances) becomes wholly or partially, temporarily or otherwise, impossible or unreasonably aggravated as a result of any situation beyond the control of the Organiser, even if this circumstance was foreseeable, the obligations of the Organizer is legally suspended for the duration of the interruption and the Organizer reserves the right to cancel the event. Without purporting to be exhaustive, such situations include: strike or lockout, fire, riot, war, epidemic, flood, electrical, computer, internet or telecommunications failures, government decisions or intervention, and errors and delays due to third parties.

For example: When the government would impose a ban on (mass) events.

For example: When the (local) government imposes a limited capacity or freedom of movement for visitors at the event.

In this case, the purchased ticket will be converted into a voucher for the corresponding value of the ticket, with the express exclusion of any refund of the purchase price of the purchased ticket, unless the visitor demonstrates that he is unable to attend the event on the new date. The voucher is a credit that the visitor can use to purchase tickets for Sunset Festival 2023 or Sunrise Festival 2024, a subsequent event of the Organizer that will take place at the same location, De Lilse Bergen on a date to be determined. Vouchers are linked to the visitor and are therefore non-negotiable and non-refundable.

ARTICLE 15
The Organizer may decide not to send out tickets until a later date shortly before the event. This is to prevent fraud and black market.

The visitor always receives a confirmation when the order of his or her ticket has been successful. Also check your spam folder of your mailbox if you have not received a confirmation. The confirmation email itself does not count as an admission ticket for the event. Only buy tickets via the official website of the Organiser: www.sunrisefestival.be.

INTERNAL REGULATIONS CAMPING SUNRISE FESTIVAL
Present regulations will be made clearly visible at the entrance as stipulated by the law.

ACCESS TO CAMPING ONLY WITH CAMPING-BRACELET IN COMBINATION WITH FESTIVAL-BRACELET

DON'T BRING FOOD, DRINKS, WEAPONS or DRUGS


EXIT POLICY: for safety reasons, you will not be able to leave the camping grounds from 01:00h after the festival ends. The camping opens every day at 07:00h.

ARTICLE 1
Persons entering the camping grounds must review these regulations and accept and comply with the provisions.

ARTICLE 2
Every person presenting him or herself at the entrance of the camping grounds must be in possession of either a valid entry ticket or a special admission issued by the organiser. One entry ticket is only valid for 1 admission of 1 person and is only valid on the day or days of the camping. When leaving the site, a new entry ticket is needed. Forging the entry ticket or any other special admission to access the site will be prosecuted without exception. The organisation reserves the right to deny visitors access to the camping from 22:00h on Friday and Saturday, and 12:00h on Sunday, regardless of a valid entry ticket or special admission issued by the organiser. Each holder of an entry ticket or a special admission issued by the organiser is at the campsite at his or her own risk releasing the organiser from any liability, including theft and accidents.

ARTICLE 3
The entry ticket or pass is neither exchangeable nor refundable by the organisation.

ARTICLE 4
The entry ticket or pass must be given upon entering the camping grounds. In exchange, you will receive a bracelet. This bracelet will give you access to the camping ground during opening hours.

ARTICLE 5
Access to the camping grounds is off-limits or refused to people who:
- are clearly under the influence of alcohol, drugs or any other stimulant;
- have been banned from festivals before, imposed by either the organiser or the administrative or legal authorities;
- show by manifest behaviour to have the intent to disturb public peace or to provoke such a thing by inciting to assault, hatred, rage, etc.;
- resist the control and the non-systematic search by the festival's security guards and security services;
- refuse to declare objects that are considered to be dangerous or off-limits by the camping's security services (see article 7);
- in any way act in violation of the provisions of one or more articles of these internal regulations.

ARTICLE 6
Every holder of an entry ticket or a special admission who desires to enter the camping and festival grounds must submit to the ticket or special admission validation. Entering the camping or festival grounds implies a possible search. The security guards can ask the holders of an entry ticket or special admission of the same sex to voluntarily submit themselves to a superficial inspection of clothing and luggage, in order to detect objects that may, when brought to the camping or festival grounds, disrupt the course of the festival or the campsite, jeopardize the safety of the other festival goers and disturb the public peace. The security guards may request to renounce these objects.

ARTICLE 7
It is forbidden for holders of an entry ticket or a special admission presenting themselves at the entrance of the camping or festival grounds as well as the persons present on the camping or festival grounds to bring, have somebody else bring or be in possession of the following objects:
- own drinks or food, bottles, glasses, drugs or stimulants and the like;
- people who require nutrients or medication for medical reasons (e.g. diabetes) must be in possession of a medical certificate;
- deodorant or perfume in big bottles or sprays (cosmetics in normal shape and size are allowed (max size 50ml);
- any apparatus (umbrella, sunshade, tripod for (movie) camera, cane) considered dangerous by the security services to the other festival goers may be refused;
- projectiles or explosives in solid, liquid or gaseous form;
- inflammable products or materials, sprays;
- pyrotechnical objects such as Bengal lights, etc.;
- Gas bottles for the BBQ, only small BBQs are allowed at the special BBQ-zone at the camping grounds;
- any weapon or dangerous, sharp or bruising object which could be used in such a way (sticks, chains, stabbing or thrust weapons and the like);
- if it can be used as a means to disturb the public peace, endanger the safety of the crowd and/or inflict damage to persons and goods;
- Dry ice;
- animals are not allowed on the camping grounds.

ARTICLE 8
On the camping grounds, it is strictly forbidden for holders of an entry ticket or a special admission to:
- try to access inaccessible sections or to be in inaccessible sections of the site in accordance with the entry ticket or the special admission, such as production rooms, artists' lodges, neutral and VIP zones, press rooms, offices, backstage, etc.;
- bring a party tent;
- climb tents, constructions, fences, closures, lighting columns, tables, benches or any other infrastructure of the site;
- obstruct the accesses, exits and evacuation routes and to linger at these locations any longer than strictly necessary for entering or exiting the site;
- disguise themselves or to avoid being recognised, to disturb the public peace and to compromise the safety of the general public;
- sell or bring to market drinks, food or any other product without the express consent of the organizer;
- throw or to shoot with any object or liquid or any other product in loose or gaseous form;
- have a bonfire;
- smoke in areas where no smoking is allowed;
- pee in public;
- all vehicles that are on the site must be equipped with a sticker, issued by the organisation. Offenders will be towed at the expense of the offender.

ARTICLE 9
Parking has to be done at the provided areas. The organisation has the right to tow incorrectly parked cars, caravans or mobile homes.
Caravans and mobile homes are not allowed at the camping grounds and there is no special area provided for them.

ARTICLE 10
Texts, symbols, images, gestures and obscene language inciting racism, xenophobia, provocation and discrimination are forbidden.

ARTICLE 11
Festival and camping goers must heed the directions of the organiser or his appointed or mandated persons at all times on the festival and camping grounds. Failure to comply will lead to a removal from the terrain. If necessary, the organiser may call on the police. The holder of an entry ticket agrees to adhere to the instructions imposed by the organiser in the framework of the public peace and safety during the event. Festival goers who are removed from the camping grounds for any of the aforementioned reasons will be denied access to the festival and camping grounds for the remainder of the festival, even if they are in possession of a new entry ticket or special admission. In case the organiser denies somebody access to the camping grounds, the former is entitled to deprive that person of his entry ticket and to deny that person further access in order to prevent that person from trying to enter the site. If the organiser has that person removed from the site, the former is not obliged to refund the entry ticket.

ARTICLE 12
For safety reasons, the organizer reserves the right to:
- interrupt or stop the festival;
- provisionally keep the festival goers on the site at the end of the festival;
- totally or partially vacate the site;
- deny access to the site regardless of the possession of a valid entry ticket. The organizer may be forced to alter the program or the timetable of the festival. In this case the entry ticket remains valid and it is neither exchangeable nor refundable.

ARTICLE 13
13.1 To give the best possible service to you, it is imperative that we track contact details and other information about you and use it. We also want to respect your privacy of course. We therefore wish to be completely in line with the new European privacy laws, the GDPR (General Data Protection Regulation) or AVG (General data protection regulation). This regulation applies from 25th May 2018: Council Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of that data.

Every person who enters the camping grounds agrees to the fact that he or she may be photographed and filmed and that the images can be registered and stored. These pictures or footage can be used by the organizer to promote the organizer collects data to prevent or detect unlawful behaviour, to protect or enforce legal rights and for security reasons. This concerns the following personal data: first name, last name, date of birth and country of residence.

Where permitted by law, the organizer may also share this personal data (first name, last name, date of birth and country of residence) to government agencies or other authorised bodies, to protect or enforce his rights or the rights of third parties, or in the detection and prevention of fraud or other crimes. These government agencies or authorized bodies may give the organiser a negative advise concerning the access of a ticket holder. In this case the organiser refuse a ticketholder admission to the event or evict that person from the event. The ticket holder will not have any right to compensation of damages.

13.2 To be able to execute your purchase, the organiser needs to share your data with third parties. By accepting these General Terms and Conditions, you explicitly give consent to share your data with the following parties for the following objectives.

13.2.1 The organizer may share your data with the following objectives:
- Check-in procedures and hospitality facilities
- Where permitted by law criminal records of ticket holders can be checked by the government agencies and in case of a negative advise by these government agencies, ticket holders can be blocked from the festival
- Customer service by Sunrise Festival and their ticket providers
- Printing of among others hard tickets (only in case you receive hard tickets)
- Reporting and statistics about visitors of Sunrise Festival
- Security, safety and health measurements
- Ticket and payment processing
- Transactional e-mails (such as e-mails to confirm the purchase of your ticket)

13.2.2 The organizer may share your data with the following parties:
- Booking companies
- Hospitality staff at check-in points
- Local and federal governments
- Mailing companies
- Operational staff on site
- Payment processing companies
- Printing companies
- Safety and health companies and staff (such as security or first aid personnel)
- Ticket providers

13.2.3 In case you want to use your right to be forgotten, the organizer needs to erase all your personal data and can no longer offer you any services necessary to fulfill your order nor give you access to the festival. In this case the order will not be refunded. Every person who enters Sunrise Festival campsite agrees to the fact that he or she may be photographed and filmed and that the images can be registered and stored. These pictures or footage can be used by the organizer to promote the festival or camping. Registering and storing these images by the police and/or organizer also takes place with the aim to ensure the enforcement of and compliance with the safety on the campsite. The processing of the images aims to prevent crimes and violations to these internal regulations and to track down and facilitate sanctioning the perpetrators by means of identification. Pictures or movies made by the festival goers on the site may not be used for commercial or public purposes, unless with written consent of the organizer.

13.3 Each person to enter the festival and camping grounds agrees to the fact that he or she may be photographed and filmed and that the images can be registered and stored. These pictures or footage can be used by the organiser to promote the festival or camping. Registering and storing these images by the police and/or organiser also takes place with the aim to ensure the enforcement of and compliance with the safety on the campsite. The processing of the images aims to prevent crimes and violations to these internal regulations and to track down and facilitate sanctioning the perpetrators by means of identification.

Pictures or movies made by the festival goers on the site may not be used for commercial or public purposes, unless with written consent of the organiser.

13.4 To provide you with the best possible, it is imperative that we track contact details and other information about you and use it. We also want to respect your privacy of course. We therefore wish to be completely in line with the new European privacy laws, the GDPR (General Data Protection Regulation) or AVG (General data protection regulation). This new law is valid from 25th May 2018

IF ANY OF THE TERMS OF THESE GENERAL CONDITIONS ARE NOT FOLLOWED ACCESS WILL BE DENIED/REFUSED WITHOUT REFUNDING THE ENTRANCE FEE. WHEN ACCESS IS DENIED/REFUSED YOU MUST LEAVE THE FESTIVAL GROUND OR CAMPING SITE IMMEDIATELY!
